1. Acceptance of Terms

By accessing or using the WePlay Studios booking platform (the "Service"), operated by WePlay Studios, located at 235 W Florence Ave, Inglewood, CA 90301, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to update these Terms at any time. Continued use after modifications constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into binding agreements to use the Service. By creating an account, you represent and warrant that you meet these requirements and that all information you provide is accurate and complete.

3. Account Registration

To make a booking, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. WePlay Studios is not liable for any loss arising from unauthorized access to your account.

4. Booking Terms

4.1 Reservations

All bookings made through the Service are subject to availability. A booking is confirmed only after you receive a written confirmation from WePlay Studios. We reserve the right to decline or cancel any booking at our discretion.

4.2 Pricing

Prices for studio time, equipment, crew, and add-on services are as displayed on the platform at the time of booking. All prices are in U.S. dollars and are subject to applicable taxes and fees. WePlay Studios reserves the right to modify pricing at any time; however, confirmed bookings will be honored at the quoted price.

4.3 Payment

Payment is processed securely through Stripe. By providing payment information, you authorize WePlay Studios to charge the specified amount. A deposit may be required at the time of booking, with the remaining balance due before or on the date of your reserved session.

5. Cancellation and Refund Policy

  • More than 7 days before the booking: Full refund of any amounts paid.
  • 3 to 7 days before the booking: 50% refund of total booking cost.
  • Less than 3 days before the booking: No refund. The full booking amount is non-refundable.
  • No-shows: No refund will be issued for missed bookings without prior cancellation.

WePlay Studios reserves the right to cancel bookings due to unforeseen circumstances (e.g., facility maintenance, force majeure). In such cases, a full refund or rescheduling will be offered.

6. Facility Usage

When using our facilities, you agree to:

  • Follow all safety guidelines and facility rules
  • Use equipment only as instructed by WePlay Studios staff
  • Vacate the premises at the end of your reserved time
  • Report any damage to equipment or facilities immediately
  • Not engage in any illegal or hazardous activities on the premises

You are financially responsible for any damage to WePlay Studios property caused by you, your employees, contractors, or guests during your booking.

7. Limitation of Liability

To the maximum extent permitted by applicable law, WePlay Studios and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, revenue, or production opportunities, arising out of or related to your use of the Service or our facilities.

Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the total amount paid by you to WePlay Studios in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless WePlay Studios and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

9. Intellectual Property

All content on the Service, including text, graphics, logos, images, software, and design elements, is the property of WePlay Studios or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Service without prior written consent.

Content you produce during your booked sessions at our facility remains your intellectual property. WePlay Studios does not claim ownership of your productions.

10. Dispute Resolution

Any disputes arising from or related to these Terms or your use of the Service shall first be attempted to be resolved through good faith negotiation between the parties. If a resolution cannot be reached within thirty (30) days, either party may pursue binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, conducted in Los Angeles County, California.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against WePlay Studios.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Los Angeles County, California.

12. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including liability limitations, indemnification, and dispute resolution) shall survive.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
